1. Acceptance of Terms
By downloading, installing, or using the Banked mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Andreas Løkken Wefring ("we," "our," or "us").
2. Description of Service
Banked is a personal finance management application that allows users to:
- Track expenses and income
- Set and monitor budgets
- Create savings goals
- Categorize transactions
- Generate financial reports and insights
- Sync data across Apple devices
- Scan receipts using AI technology (Premium feature)
3. User Accounts
To use certain features of the App, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized access or use of your account
- Accept responsibility for all activities that occur under your account
You must be at least 13 years old (or 16 in the EEA) to create an account and use the App.
4. Subscriptions and Payments
Free Tier: The App offers a free tier with limited features, including transaction limits and advertisements.
Premium Subscription: Premium features are available through in-app purchases:
- Monthly: Recurring subscription billed monthly
- Yearly: Recurring subscription billed annually (best value for recurring)
- Lifetime: One-time purchase for permanent access
5. Refund Policy
All purchases are processed through Apple and are subject to Apple's refund policies. To request a refund for an in-app purchase, you must contact Apple Support directly through their website or the App Store.
6. User Conduct
You agree not to:
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to the App or its related systems
- Interfere with or disrupt the App's functionality or servers
- Reverse engineer, decompile, or disassemble the App
- Use the App to transmit harmful code, malware, or viruses
- Violate any applicable laws or regulations
- Impersonate any person or entity
- Use automated systems or bots to access the App
7. Intellectual Property
The App, including its design, features, functionality, graphics, and content, is owned by Andreas Løkken Wefring and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
8. User Data
You retain ownership of the financial data you enter into the App. By using the App, you grant us a limited license to process your data as necessary to provide the service.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF CONTENT
We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or harmful components.
10. Financial Disclaimer
We are not responsible for any financial decisions you make based on information displayed in the App.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or data
- Business interruption
- Personal injury or property damage
- Any damages arising from your use or inability to use the App
Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the 12 months prior to the claim, or $100, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Andreas Løkken Wefring from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
13. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.
You may terminate your account at any time by deleting your account through the App's Settings. Upon termination, your right to use the App will immediately cease.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date.
Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
16. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Norway, except that either party may seek injunctive relief in court for intellectual property violations.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
